Terms

Website Terms of Use.

The terms that govern your access to and use of the Brandtuit website.

Last updated: September 27, 2026

These Website Terms of Use (these "Terms") govern your access to and use of brandtuit.com and every page, sample report, video and other material we publish there (together, the "Site"). The Site is operated by Brantuit, LLC, a Wyoming limited liability company doing business as Brandtuit ("Brandtuit," "we," "us" or "our").

By accessing or using the Site, you agree to these Terms. If you use the Site on behalf of a company or other organization, you confirm that you have authority to accept these Terms for it, and "you" includes that organization. If you do not agree, do not use the Site.

1. What these Terms cover

1.1 The Site only. These Terms cover browsing the Site and using its public features. They do not cover any account, purchase or subscription.

1.2 Paid products. Zena, Brandtuit's AI brand manager, and our related products, including Brand Sentinel, Category Sentinel, Ask Zena, Burst Alerts, Monthly Reports and Decision Briefs (together, the "Services"), are governed by our Client Terms of Service (the "Client Terms"), together with any order form, checkout page or statement of work you accept (an "Order"). If your organization has signed a written agreement with us, that agreement governs.

1.3 Order of precedence. If these Terms conflict with the Client Terms, an Order or a signed agreement, the Client Terms, Order or signed agreement controls.

2. Eligibility

The Site is intended for business use by people located in the United States. By using it, you confirm that you are at least 18 years old and are using the Site for business purposes. We do not direct the Site to consumers or to anyone outside the United States.

3. Sample materials and illustrations

3.1 Illustrations only. The Site includes sample reports, example questions and answers, product screens and other illustrations ("Samples"). Samples show our format and approach. Some feature fictional brands, companies and data, such as "Acme Vitamins." Fictional names and data are fictional, and any resemblance to a real company or person is unintended.

3.2 Real companies and categories. Where a Sample refers to a real company, brand, product, retailer or category, it reflects publicly available information as of the date shown or the date the Sample was prepared. That information may be incomplete or out of date. A Sample is not an assessment of, or advice about, any real company or brand.

3.3 Results vary. Any example outcome shown on the Site illustrates how the Services can be used. It is not a promise of any particular result.

4. No professional or investment advice

Nothing on the Site is legal, financial, investment, tax, accounting, regulatory or scientific advice. Nothing on the Site is an offer to sell or a solicitation to buy any security, or a recommendation about any transaction, including any acquisition, investment, financing or sale of a business. You should not rely on the Site in making any investment or transaction decision. Consult your own advisors.

5. AI-generated content and human review

5.1 AI content. Zena is an AI product. Some Site content, including Samples, was produced with the help of artificial intelligence. AI output can be inaccurate, incomplete or out of date, and you should evaluate it before relying on it. You are responsible for evaluating Site content and for making your own business decisions based on your circumstances.

5.2 Human review. In the Services, Monthly Reports and Decision Briefs are reviewed by a senior brand operator before delivery. Burst Alerts and Ask Zena responses are generated automatically and are not individually reviewed by a person before you receive them. The Client Terms describe each product in full.

6. Intellectual property

6.1 Our content. Brandtuit and its licensors own the Site and all of its content, including text, graphics, Samples, designs, frameworks, software and the selection and arrangement of that content. The Site is protected by copyright, trademark and other laws.

6.2 Your limited license. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your internal business evaluation of the Services. You may print or save a reasonable number of pages for that purpose if you keep all proprietary notices intact. All rights not expressly granted are reserved.

6.3 Our trademarks. Brandtuit, Brantuit, and our product names, logos and slogans are trademarks or trade names of Brantuit, LLC. You may not use them without our prior written permission.

6.4 Third-party names. References on the Site to third-party companies, brands, products and retailers, including brands that members of our team worked on in prior roles, are for identification and descriptive purposes only. They do not mean that any third party endorses, sponsors or is affiliated with Brandtuit. Third-party trademarks belong to their owners.

7. Acceptable use

You will not, and will not help anyone else to:

  1. copy, scrape, frame, mirror, republish, sell or redistribute any part of the Site, including Samples, except as Section 6.2 allows;
  2. access or collect data from the Site using bots, crawlers, scrapers or other automated means, except general-purpose search engines that follow our robots.txt file;
  3. use the Site or any of its content to develop, train, fine-tune or evaluate any artificial intelligence model or any product that competes with the Services;
  4. attempt to extract prompts, system instructions, scoring frameworks or other underlying logic from any interactive feature of the Site;
  5. probe, scan or test the vulnerability of the Site, breach any security or authentication measure, or interfere with the Site's operation, including by sending malware or excessive traffic;
  6. misrepresent your identity or affiliation, or impersonate any person or organization; or
  7. use the Site in violation of any applicable law or the rights of any third party.

We may suspend or block access to the Site at any time for any conduct we believe violates these Terms.

8. Information you send us

8.1 Do not send confidential information through the Site. Contact forms, sign-up fields and email links on the Site are not designed for confidential information. Please do not send us material nonpublic information, trade secrets, transaction documents or other confidential information through the Site. Confidential information you share once you are a customer is protected under the Client Terms or your signed agreement.

8.2 Feedback. If you send us ideas, suggestions or other feedback about the Site or the Services, we may use it for any purpose without restriction or obligation to you.

9. Third-party sites

The Site may link to websites, content or services that we do not own or control. We are not responsible for them, and a link is not an endorsement. Your use of any third-party site is governed by that site's terms.

10. Privacy

Our Privacy Policy explains how we collect, use and disclose information through the Site and the Services.

11. Disclaimers

THE SITE AND ALL OF ITS CONTENT, INCLUDING SAMPLES, ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, BRANDTUIT DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY AND QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT IS COMPLETE OR CURRENT.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

(a) BRANDTUIT AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF THOSE DAMAGES; AND

(b) BRANDTUIT'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

These limits apply to every theory of liability, including contract, tort (including negligence) and strict liability. They apply to use of the Site only. Liability relating to the Services is governed exclusively by the Client Terms, the applicable Order or your signed agreement.

13. Indemnification

You will defend, indemnify and hold harmless Brandtuit and its members, managers, officers, employees, contractors and agents from and against any third-party claim, and any resulting loss, liability, damage, cost or expense (including reasonable attorneys' fees), arising out of your violation of these Terms or your misuse of the Site.

14. Governing law, venue and jury waiver

These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules. Any such dispute will be brought exclusively in the state or federal courts located in the State of Wyoming, and each party consents to the personal jurisdiction of those courts. TO THE FULLEST EXTENT PERMITTED BY LAW, EACH PARTY WAIVES ANY RIGHT TO A JURY TRIAL IN ANY SUCH DISPUTE. Any claim relating to the Site must be brought within one (1) year after it arises.

15. Changes to these Terms

We may update these Terms from time to time by posting a revised version on the Site and changing the "Last updated" date above. Changes take effect when posted and apply to your use of the Site after that. If you do not agree to the changes, stop using the Site.

16. General

16.1 Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and Brandtuit about the Site. They do not replace the Client Terms, any Order or any signed agreement.

16.2 Severability and waiver. If any provision of these Terms is held unenforceable, it will be enforced to the maximum extent permissible and the rest of these Terms will remain in effect. Our failure to enforce any provision is not a waiver.

16.3 Assignment. You may not assign these Terms without our prior written consent. We may assign them without restriction.

16.4 No third-party beneficiaries. Except as provided in Sections 12 and 13, these Terms do not create rights for any third party.

16.5 Electronic communications. You agree that notices and other communications we provide electronically satisfy any requirement that they be in writing.

16.6 Export. You will comply with all applicable U.S. export control and sanctions laws in using the Site.

16.7 Headings. Headings are for convenience only. "Including" means "including without limitation."
